1. Acceptance of Terms

Welcome to zenithradar.com (« Zenith Radar », « we », « us », or « our »). These Terms & Conditions (« Terms ») govern your access to and use of our website, tools, content, and services (collectively, the « Services »).

By accessing, browsing, or using Zenith Radar, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

These Terms constitute a legally binding agreement between you and DRU Dominique, the operator of Zenith Radar. Please review them carefully.

2. Description of Services

Zenith Radar provides educational financial analysis tools, market intelligence, and premium content designed to help users make more informed trading decisions. Our Services include:

• Quantitative Analysis Tools: 14+ proprietary algorithms including HMM Scanner, Smart Money Tracker, Wyckoff Detector, and more.
• Market Intelligence: Real-time data analysis, probability assessments, and market regime detection.
• Educational Content: Methodology guides, strategy frameworks, and analytical tutorials.
• Zenith Radar Club: Premium membership providing full access to all tools, updates, and priority support.

3. Eligibility

To access or use Zenith Radar, you represent and warrant that:

• You are at least 18 years of age (or the age of majority in your jurisdiction).
• You have the legal capacity to enter into a binding contract.
• You are not prohibited from accessing our Services under applicable laws.
• You are not located in a jurisdiction where access to financial analysis tools is restricted by law.

If you are accessing Zenith Radar on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

4. Account Registration & Security

4.1 Registration

To access premium features, you must create a Zenith Radar Club account by providing accurate and complete information, including a valid email address. You agree to keep your account information up to date.

4.2 Account Security

You are solely responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Immediately notifying us at contact@zenithradar.com of any unauthorized access or security breach.

We are not liable for any loss or damage arising from your failure to protect your account credentials or from unauthorized access that you fail to report promptly.

5. Subscription & Payment Terms

5.1 Pricing

Zenith Radar Club memberships are offered at a founder price of $97 USD per month. Prices are subject to change for new subscribers; however, existing members who joined at the founder price will retain this rate for life, provided their subscription remains active.

5.2 Billing & Payment

• Subscriptions are billed monthly in advance via secure third-party payment processors (Stripe, PayPal, etc.).
• You authorize us to charge your selected payment method for each billing cycle until you cancel.
• Failed payments may result in suspension of access until payment is resolved.
• All fees are non-refundable except as expressly stated in these Terms or required by applicable law.

6. Intellectual Property Rights

All content, algorithms, tools, software, designs, logos, trademarks, and materials available through Zenith Radar (« Zenith Radar Content ») are the exclusive property of DRU Dominique / Zenith Radar and are protected by copyright, trademark, and other intellectual property laws worldwide.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Access and use the Services for your personal, non-commercial use.
• View, analyze, and utilize the educational content and tools provided.

You may not: reproduce, distribute, modify, create derivative works of, publicly display, reverse engineer, decompile, or attempt to extract source code from any Zenith Radar Content; sell, rent, lease, or sublicense access to the Services; or use any data mining, robots, or automated systems to access or scrape our Services without express written permission.

7. User Conduct & Prohibited Activities

You agree not to use Zenith Radar to:

• Violate any applicable law, regulation, or third-party rights.
• Engage in fraudulent, deceptive, or harmful activities.
• Transmit malware, viruses, or any malicious code.
• Interfere with or disrupt the integrity or performance of the Services.
• Attempt to gain unauthorized access to our systems, accounts, or data.
• Share your account credentials or allow third parties to access your account.
• Use the Services for any illegal trading activity, market manipulation, or insider trading.
• Scrape, crawl, or automate access to our content without prior written consent.

We reserve the right to suspend or terminate your account immediately, without notice or refund, if we determine you have violated these Terms.

8. Content Disclaimer: Educational Use Only

• Financial, investment, legal, or tax advice.
• A recommendation to buy, sell, or hold any security or financial instrument.
• A guarantee of future performance or results.
• A substitute for your own independent research and due diligence.

Trading involves substantial risk of loss. Past performance, backtested results, or hypothetical examples are not indicative of future results. You are solely responsible for your trading decisions and outcomes.

By using Zenith Radar, you expressly acknowledge and agree that:
• You understand the risks of trading financial instruments
• You will conduct your own research before making any investment decision
• You accept full and sole responsibility for your trading results
• Zenith Radar, its operators, and affiliates shall not be liable for any losses arising from your use of our Services

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• NO CONSEQUENTIAL DAMAGES: In no event shall Zenith Radar, DRU Dominique, or our affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
• AGGREGATE LIABILITY CAP: Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or your use of the Services shall not exceed the amount you paid to Zenith Radar in the six (6) months preceding the claim, or $100 USD, whichever is greater.
• AS-IS BASIS: The Services are provided « AS IS » and « AS AVAILABLE » without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you live in such a jurisdiction, the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Zenith Radar, DRU Dominique, and our affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your violation of any applicable law or regulation.

11. Termination & Suspension

11.1 By You

You may terminate your account at any time by canceling your subscription through your account dashboard. Upon cancellation, you will retain access until the end of your current billing cycle.

11.2 By Us

We reserve the right to suspend or terminate your access to the Services, with or without notice, if:

• You breach any provision of these Terms.
• We are required to do so by law or legal process.
• Your conduct poses a risk to the security, integrity, or availability of our Services.
• We discontinue or modify the Services (with reasonable notice where feasible).

Upon termination, all licenses granted to you under these Terms immediately cease, and you must discontinue all use of the Services.

12. Governing Law & Dispute Resolution

12.1 Governing Law

These Terms and your use of Zenith Radar shall be governed by and construed in accordance with the laws of [Your Jurisdiction, e.g., France], without regard to its conflict of law principles.

12.2 Dispute Resolution

• Notify you via email or dashboard notice if changes are material
• Provide an opportunity to review changes before they take effect (where required by law)

Your continued use of Zenith Radar after any update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our Services and cancel your subscription.

14. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy and Risk Disclosure, constitute the entire agreement between you and Zenith Radar regarding the Services.
• Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless expressly acknowledged in writing.
• Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
• Force Majeure: We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, war, terrorism, government action, or technical infrastructure failures.
• Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.
